Who pays for a lift repair in a Maltese apartment block?

A plain-language guide for apartment owners in Malta.

Short answer

Usually all the owners who share the lift, through the block's common expenses. The Condominium Act treats lifts as common parts unless the deeds say otherwise (Cap. 398, article 5), and shares the cost by the value of each unit unless the owners agreed differently (article 11). An owner who cannot use the lift may carry a smaller share.

What the law says

Lifts, stairs and roofs are listed as common parts unless the title or a public deed says otherwise (article 5). Costs are split in proportion to the value of each unit, unless the owners have agreed otherwise (article 11(1)).

Where owners can make different use of a common part, the cost follows the use each one can make of it (article 11(2)). Where a part serves only some owners, those owners carry its cost (article 11(3)). So a ground-floor unit with its own street entrance may pay less towards the lift. Check your deeds and any agreement between the owners.

Maintenance contract, repair or insurance?

A lift maintenance agreement pays for scheduled servicing and the technician's time. It is not insurance, and parts are usually quoted separately. Damage from a power surge, water in the shaft or misuse may be an insurance matter if the block has lift cover.

Ask for the supplier's written fault report and quote before owners are asked to pay, unless the lift is unsafe and must be made safe at once.

Who decides?

The administrator can act on their own to preserve the common parts, and those measures bind all the owners (articles 16(1)(d) and 19(1)), so urgent safety work does not wait for a meeting. Extraordinary repairs need a decision of the owners' meeting, by two-thirds of the units represented (article 22(7)).
