Short answer
Yes. Under Malta's Condominium Act the administrator is appointed and removed by the owners' meeting, not by the developer (Cap. 398, articles 15 and 22). Removing an administrator needs two-thirds of the units represented at a properly called meeting; a new one is then appointed by simple majority. A developer votes for each unit it still owns.
How the vote works
The meeting must be called with at least seven days' notice (article 22(4)). The quorum is two-thirds of the units; if it is not reached, the meeting is adjourned by a week and the owners present then form the quorum (article 22(6)).
Removing the administrator needs two-thirds of the units represented at the meeting (article 22(7)). Appointing the new administrator needs a simple majority of the units represented (article 22(8)). Owners can also ask an arbitrator to revoke an administrator (article 15(4)), and if the meeting fails to appoint one, the appointment goes to arbitration (article 15(1)). A developer that holds more than a third of the units at the meeting can block a removal.
After the vote
The administrator must notify the Land Registry of the appointment and any change within fifteen days (article 15(6)); any owner may also do so (article 15(7)). Unless the appointment says otherwise, an administrator holds office for two years and stays on until a replacement is appointed (article 15(2)).
Ask the outgoing administrator for the records, accounts, supplier contracts, insurance details and block funds, and get the handover in writing.
